1. General Provisions
1.1. These Terms and Conditions ("Terms") govern the use of the CabinPlanner log cabin configurator application ("Configurator") by both business-to-business (B2B) partners and business-to-consumer (B2C) clients (collectively "Users").
1.2. By accessing or using the Configurator, Users agree to be bound by these Terms. If Users do not agree, they must refrain from using the Configurator.
1.3. CabinPlanner.eu reserves the right to update or amend these Terms at any time without prior notice. The latest version will always be available on our website.
2. Product Representation and Disclaimer
2.1. Colour Representation:
- CabinPlanner has made every effort to display colours as accurately as possible in the Configurator. However, colours displayed may differ from the original product due to factors such as screen settings (contrast, brightness, saturation), type of screen, printer settings, gloss levels, incident light, and the surrounding environment.
- Windows and doors colours, hardware kits, design, and opening directions may differ from the real products. We strive to represent them as accurately as possible, but some variations may occur in the final product.
- All colour descriptions and names represent shades based on human perception. They are intended to provide a general understanding and no rights can be derived from them.
- Users with concerns regarding colours should inquire before placing an order.
2.2. Visual Representations:
- Images and 3D projections generated by the Configurator are for illustrative purposes only. No rights can be derived from these images, as they may differ from reality.
2.3. Measurements and Dimensions:
- Heights, lengths, widths, and total measurements displayed in the Configurator may, due to technical reasons, slightly differ from the delivered products.
- If clients require specific and accurate measurements, they should inform the sales representative (manager) before proceeding with the order.
3. Product Modifications and Technical Adjustments
3.1. CabinPlanner reserves the right to make modifications to the look or technical view of projects, colours, designs, materials, any changes for additional products, and construction without prior notice.
3.2. Technical or structural adjustments may be necessary for reasons such as efficiency, resulting in differences between the configured and delivered products. Users may request specific details of these adjustments after ordering.
3.3. Such modifications do not entitle Users to compensation or cancellation of orders unless otherwise agreed in writing.
4. Intellectual Property Rights
4.1. All contents of the Configurator, including but not limited to images, 3D models, descriptions, software, and designs, are the intellectual property of CabinPlanner or its licensors.
4.2. All rights are reserved under applicable copyright laws. No content from the Configurator may be reproduced, copied, forwarded, or published in any form without the express written consent of CabinPlanner.
4.3. Several products offered via CabinPlanner may be protected by patents and/or registered designs.
5. Pricing
5.1. All prices displayed in the Configurator are indicative and subject to change without notice.
5.2. The final price will be confirmed upon order placement and may include additional costs such as delivery fees, taxes, or charges related to technical modifications.
5.3. If the order is canceled after the drawing has been completed, an additional charge of 150 EUR will apply.
5.4. The price is valid for 30 days after order placement. If the order exceeds this time period, CabinPlanner reserves the right to review and update the price based on the latest pricing, informing the client accordingly.
5.5. While the order is not placed, CabinPlanner reserves the right to change the price of elements, edit calculation rules, prices of items, additional products, and other components without informing the client.
6. Limitation of Liability
6.1. CabinPlanner shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of Users' access to, use of, or inability to use the Configurator or any inaccuracies in the displayed products.
6.2. Users acknowledge that reliance on information provided by the Configurator is at their own risk.
7. Governing Law and Jurisdiction
7.1. These Terms shall be governed by and construed in accordance with the laws of Lithuania.
7.2. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Lithuania.
8. Final Provisions
8.1. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain valid and enforceable.
8.2. These Terms constitute the entire agreement between Users and CabinPlanner concerning the use of the Configurator and supersede any prior agreements or understandings.
